1. GENERAL SALES CONDITIONS FOR THE USE OF THE WEBSITE CRESPOBEAUTY.IT
1.1 The present general sales conditions have as main subject the purchase of a product made through the various technological systems or by telephone, of all products presented on the website www.crespobeauty.it, managed by:

And constitute the essential part of the sales contract of any Product. Forwarding an Order, as further described, involves that the Client accepts the following sales conditions.
1.2 The forecast that are referred to “Consumers” are applicable exclusively for those subjects that are physical people and that make an Order for scopes that do not include any entrepreneur, merchant or professional eventual scopes. The Consumers, as just described, will benefit of all the protections provided by the law, in particular for the withdrawal from a contract at distance, Title III, Section II of the Dlgs 6 September 2005, n. 206 (Code of Conduct of the Consumer), as modified by the Dlgs 21.02.14 n.21 to actuate the new directive 2011/83/EU. All further provided safeguards in favor of the Consumer made by the above mentioned Code and by any other applicable law, will remain valid. 1.3 The general conditions apply to all the purchases made through the website www.crespobeauty.it.
1.4 By “Client” we mean the “Consumer” (physical person that makes a purchase for his own scope and not for entrepreneur, sales, artisanal or professional reasons), as well as the “Professional” (physical or juridical person which order products within his own entrepreneurial, commercial, artisanal or professional activity).
1.5 By “Order” we mean that every purchase of one or more item, made by a client online, whilst with “Contract” we mean the agreement between Crespo and the Client which buys one or more products. The formulation of the order with the subsequent conclusion of a contract will be done accordingly to the following mode.
1.6 By “Products” we mean the products, the accessories and the tools for the cure of the hair that are indicated in the catalog , which is accessible by clicking on the voice “products” in the pages of the website.
1.7 We underline that “Working days” is referred to any day of the week, with exception of Saturday, Sunday and those Festivities as designated by the Italian Law.
1.8 The Client will be able to keep a copy of the present general sale conditions, conditions for returns and privacy, by saving them on their own computer.
1.9 The Client will be able to archive the data of his own order with the confirmation email that Crespo will send, together with the forwarding of the order, to the email address that the client will provide. This confirmation email will contain the data of the order as expressed by the Client and with the possibility to print or save this documentation.
1.10 The data of each Order will be saved by Crespo in their own system. In order to preserve the confidentiality of such information, the Client will only be able to access this only by accessing the reserved section of the website known as “Account”, by inserting the proper access credentials which will be given during the registration to the website. In this reserved area, after inserting the credentials, the Client will be able to look at those already concluded contracts, the pending orders, those new ones, add and save personal contact details, any eventual bank and other relative data for subscribing to the newsletter.
1.11 Crespo will save data in their own technological registry which are considered as proof of communication, of the orders and of the payments which have occurred between the parties.

2. CONCLUSION OF THE CONTRACT
2.1 Any contract related to the purchasing of Products will be stipulated only in Italian.
2.2 Before any order can be treated, the Client should read carefully all the present general conditions of the sales. Before moving forward with the shipment we may ask you to print beforehand the order’s module via the printing options or save a copy for personal use.
2.3 The presentation of products on the internet is only used as an invitation to clients to make a purchasing proposition and it does not have a binding relation with Crespo and in particular it does not act as an offer for the public as per art. 1336 of the Italian Civil Law. The final decision is at full discretion of Crespo if choosing to accept the final proposal.
2.4 Concluding the contract via internet
2.4.1 In order to buy one or more Products via the website, the Client will provide Crespo all of the necessary data to allow Crespo to forward all of the orders.
2.4.2 The Client will be able to choose one or more products of which he wishes to buy, by adding them to the “virtual cart”, of which he will always be able to view the content before proceeding to forwarding the order.
2.4.3 By clicking on the “CONTINUE WITH PAYPAL”, the Client will start the forwarding of the order. During the phase of the formulation of the order and until the actual payment, the Client will be able to double check all of the inserted data by clicking on the “Back” button, in order to view and change any eventual mistaken information.
2.4.4 By Clicking on the “CONTINUE WITH PAYPAL” the Client will forward the order to Crespo.

3.PRICES AND SHIPMENT COSTS
3.1 All prices of products advertised on the website do not include IVA and other eventual taxes and fees due to the destination country of the Products, when these are meant to leave Italy’s borders, and they will be charged on the buyer.
3.2 The prices of the shown products on the website are subject to change at any moment and without previous alert, not including those orders already forwarded or those already accepted by Crespo, understanding that there are sales conditions to be applied.
3.3 The cost for the delivery is free for those shipments with a total higher than 49,00€ with taxes included for shipments within Italy. In case the orders have a cost below such fee, the cost will be of 4,90€ (except promotions). For shipments outside of the Italian national territory the cost will depend on the destination of the items. The cost for each separate shipment will be displayed automatically before the final order confirmation.

4.SHIPMENT AND DELIVERY
4.1 For the delivery in Italy, Crespo will use the GLS carrier. Our products are delivered to the address given by the Client on the order and only in the areas that are possible to reach by the couriers that operate for Crespo. Crespo will reserve the decision to eventually not follow up an Order’s delivery outside of the Italian territory. For deliveries outside the national territory, Crespo will use the BRT carrier.
4.2 The delivery times are within 48/72 hours for Sicily, Calabria, Sardinia and 24/48 hours for the other Italian regions. Deliveries are done from Monday to Friday and eventual times are given as an estimated one. For deliveries outside the national territory through the BRT carrier, the times are estimated in 2-4 days for Austria, Belgium, France, Germany, Luxembourg, the Netherlands (10€); 3 days for Spain (14€); 4 days for Portugal (20€). In any case if the deadline has passed the limit, there will be no refunds, because as the Italian law states the shipment will eventually occur before the 30 days provided by contract.
4.3 Without any specific information delivery will be made at ground floor.
4.4 At the time of the items delivery by the courier, the Client is asked to: a) check that the number of packages corresponds to what is indicated in the transportation document; b) that the packaging results as intact, not damaged, no wet or not altered, not even in the sealing (tape or plastic ties).
4.5 In case a damaged package or an unconventional item is delivered, the Client has the possibility to reject the delivery (indicating the reason on the delivery note) and shall forward the communication to Crespo, as indicated on the return conditions.
4.6 Eventual damages to the packaging and/or to the product or the missed correspondence of the number of items or the indications must be immediately contested, by writing “ACCEPTED WITH RESERVATIONS” on the receipt of the courier. Once the document of the courier has been signed, the Client will not be able to contest any of the characteristics of what has been delivered. We invite the Client to always sign the confirmation with “reservation of control”. In case this is missing and the Client shall find damages on the products the courier will not be held responsible, even with insurance. Any problems linked to the integrity, to the correspondence or the completeness of the received products have to be signaled as indicated in the return conditions.
4.7 If the delivery has not been concluded after 5 working days from the confirmation of the order, the Client shall inform Crespo by phone or through the contact module. A complaint shall be made to the courier in order to understand the reason of the delay.
4.8 In case of missed recipient, the person in charge with the delivery shall leave a notice of missed delivery in the Client’s mailbox.
4.9 In case of missed pick up within 5 working days, the products that have been left in stock at the courier’s warehouse will automatically cancel the order, since the products have not been picked up they will be given back to Crespo. In this case the Client is asked to give back to Crespo the costs of double shipment (towards Client and return to Crespo).
4.10 The list of all products contained in the package will be included with the package and the detail of the shipments’ costs.
4.11 Crespo will not be responsible of the missed or delayed shipment due to causes of major force, which are for instance strikes, measures of the Public Authority, rationing of electricity or prime materials, difficulty in transportation, fires, floods, damages to industrial machines. If the cause of major force is extended for a period longer than 30 days, each of the parties will have the faculty to withdraw from the contract. In case of withdrawal, the Client will not have any right to compensation of any title, with the exception of the reimbursement for anything that has already been already paid as a price for the Product.
4.12 Crespo will not be responsible for any delays which are linked to the couriers, especially in the case of products being lost, of bad weather or strike.
4.13 In case a delivered product is not the ordered one, you may contact Crespo and proceed with the restitution as can be found in the condition for returns. The packaging shall be always perfectly intact.

5.PAYMENT
5.1 The Client will pay the full price of the ordered products after the placement of the order. In case of missed acceptance of the order, Crespo will immediately provide to reimburse the Client of those expenses covered.
5.2 During the forwarding of the Order, Crespo will be able to propose different methods of payment, for instance paying by credit card (Visa, MasterCard, American Express), the payment through the protected system of “PayPal” and with prepaid card (i.e. “PostePay”), the Client shall indicate the preferred type of payment he will use.
5.3 For orders made by phone, the payment will have to be done through the online payment linked for credit card (Visa, MasterCard, American Express), prepaid card (i.e. PostePay), or through the PayPal protected system.
5.4 When the product is signed as “available” on the website, Crespo will provide to send the item under the modality and the times as indicated. In any case, the availability as reported on the website is to be intended as non-bonding as the quantity indicated could not correspond to the actual quantity in the warehouse. Crespo will not be responsible for the missed or delayed delivery in case the ordered products are not delivered by the supplier/manufacturer to Crespo itself or, in any case that are not available.
5.5 In any case, when the Client is a Consumer and the unavailability of the products does not allow the product to be delivered within 30 days from the placed order, Crespo will provide to reimburse the Consumer of any prepaid items.

6.RIGHT TO WITHDRAWAL
If the Client is a Consumer he will be able to use the right to withdrawal from the contract for any sort of reasons, without the necessity to provide clarifications, based on the modalities and conditions illustrated in the Returns and Refunds chapter.

7. GUARANTEE AND HANDLING COMPLAINTS
7.1 The products bought by the Consumers will apply the specific regulations within the guarantee, taxation and other norms expected by the Consumer Code of Conduct.
7.2 The Website of www.crespobeauty.it and their partners have tried to provide the most exact information and therefore are not to be held accountable for consequences, accidents, special damages that are the result of electronic transmissions or made by the inaccuracy of the transmitted information. The names and the brands of products and of makers are used only in order to identify products. The pictures and the descriptions are only exemplary. The images placed close to the descriptive page of a product could not represent the exact characteristics, but may vary by color, dimensions and accessories presented in the figure. All of the supportive information are to be intended as simple informative material, generic and not to be associated to the real characteristic of each product.
7.3 The guarantee will be applied to products that present issues of conformity and malfunctions not visible at the time of the purchase, however the product must be used correctly and with the righteous diligence and thus in respect of its final scope as provided in the eventual technical documentation and with respect of the various regulations. The guarantee mentioned above will not be applicable in case of negligence, careless use, lack of proper conservation and maintenance of the product; this regards those electronic products of to those items connected to non-adept methods. The guarantee is personal and will only be applied to the original buyer, as it is reserved for direct clients and not intended for merchants or resellers, etc.
7.4 Where defects in the Products to be bought as presented before by the regulations, the Consumer will be able to contact Crespo, within two months of the discovery and within the indicated modality of the present general conditions of sales and request the reparation or the substitution of the Product. The choice between reparation and substitution remains within the availability of the Consumer, unless the chosen method of reparation is unfeasible or excessively costly in comparison to the second choice. 7.5 Crespo does not takes charge of quality, packaging and labeling of products, unless for the right of withdrawal chosen by the Client.
7.6 We underline that the conditions of guarantee above mentioned will not be applied when defects found on any Product bought by Professionals, to which Crespo does not provide any guarantee.

8.PURCHASE VOUCHERS
8.1 Purchase Vouchers (also known as Coupon or discount coupon) cannot be bought on the website, but are offered by Crespo during promotional campaigns, for a limited period of time.
8.2 Purchase Vouchers are valid until the indicated terms and can be used only once during one order. The Voucher can be used only before the order has been placed (before clicking on “Place Order”, at the end of the procedure). Beyond this point no discounts can be applied. Vouchers can be used only for the purchase of some specific products, as shall be indicated on the website.
8.3 The Voucher is non-refundable in cash and they do not mature interests on credits that covers the value of the voucher. The credit covered by the Voucher cannot be passed on to others. The credits represented by every single Voucher cannot be cumulated with other Vouchers.
8.4 The value of the Products bought with the Vouchers has to correspond to at least to the value of the voucher. In case the purchase has a lower value than the value of the voucher, we will not be able to reimburse the Client with an eventual leftover credit.
8.5 If the credit represented by a Voucher is inferior to the total due price of an order, the difference can be paid with the other methods allowed.
8.6 The Voucher will not be reimbursed if the products are partially or totally returned.

9. DATA PROTECTION
Crespo reserves the right to keep the data of each Order as well as the personal information of the Client, to use them for the correct execution of the order as has been described in the Privacy Policy chapter.

10. ALTERATION OF GENERAL SALES CONDITIONS
10.1 In occasion of every single modification to the present general conditions of sales, Crespo will provide immediate publishing the modification of the general conditions of sale.
10.2 The modified general conditions of sales will become part of the new Contracts, from the first forwarded order onwards, after the publication on the website.

11. SUBSTITUTION RESERVATION
Whenever a present or future alteration of the general sales conditions should become partially or completely inefficient, and thus there shall be a gap in the dispositions of the general conditions, the past conditions will in any case remain valid and efficient.

12. GIURISDICTION AND COMPETENT COURT
The sales contract between the Client and Crespo can be intended as concluded in Italy as regulated by the Italian Law. For the solution of civil and penal controversies derived by the conclusion of said contract of sales abroad, the territorial competency is only the one provided by the Roman Forum, unless the Client is a Consumer (as seen above), for which the judge of the residence or domicile region of the Consumer will be used.
